PARENTING AGREEMENTS AND THE FAMILY LAW BILL
Stepfamily Scotland were invited to give evidence before the Justice 1 Committee of the Scottish Executive as part of
the proposed Family Law (Scotland) Bill. A number of issues arose including the possibility of the Bill including a
provision to allow stepparents to acquire parental rights by agreement. Despite securing support from a number
of MSPs, our proposed amendment was rejected.
However, the Scottish Executive have decided to take some non-legislative measures, including the introduction of a Parenting
Agreement which will allow arrangements for contact between parents and children to be agreed informally. The Parenting
Agreement will have no binding legal effect but will be a useful tool in avoiding disputes when families separate.
